class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>En Colombia, el C\u00f3digo Sustantivo del Trabajo establece las directrices para el per\u00edodo de prueba en sus art\u00edculos 76 al 80. Estos art\u00edculos definen el per\u00edodo de prueba como una etapa inicial del contrato de trabajo y establecen lo siguiente:<\/p><ol><li>El per\u00edodo de prueba debe ser acordado por escrito, y en su ausencia, se aplicar\u00e1n las normas generales del contrato de trabajo.<\/li><li>La duraci\u00f3n m\u00e1xima del per\u00edodo de prueba es de dos meses, o en el caso de contratos a t\u00e9rmino fijo de menos de un a\u00f1o, no puede exceder la quinta parte de la duraci\u00f3n inicial pactada.<\/li><li>El per\u00edodo de prueba solo se puede estipular en el primer contrato, excluyendo contratos sucesivos entre las mismas partes.<\/li><li>Las partes pueden prorrogar el per\u00edodo de prueba antes de su vencimiento, siempre respetando los l\u00edmites de duraci\u00f3n establecidos.<\/li><\/ol><p>\u00a0<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-6fc98c1\" data-id=\"6fc98c1\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap\">\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-0301f21 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"0301f21\" data-element_type=\"section\" data-e-type=\"section\" data-settings=\"{&quot;ekit_has_onepagescroll_dot&quot;:&quot;yes&quot;}\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-392bcaf\" data-id=\"392bcaf\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-67774ea elementor-widget elementor-widget-text-editor\" data-id=\"67774ea\" data-element_type=\"widget\" data-e-type=\"widget\" data-settings=\"{&quot;ekit_we_effect_on&quot;:&quot;none&quot;}\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>En relaci\u00f3n con el despido durante este periodo, el art\u00edculo 80 ib\u00eddem establece que, durante esta fase, \u201c\u2026 Puede<em>\u00a0darse por terminado unilateralmente en cualquier momento, sin previo aviso<\/em>\u201d. Sin embargo, esta decisi\u00f3n debe basarse en una causa objetiva. Si el empleador no puede demostrar una justa causa objetiva, el trabajador puede alegar un despido ilegal, y el juez podr\u00eda ordenar su reintegro.<\/p><p>La importancia de este art\u00edculo radica en que el objetivo fundamental del per\u00edodo de prueba, seg\u00fan el art\u00edculo 76, es que el empleador eval\u00fae las aptitudes del trabajador. Por lo tanto, la falta de aptitudes se convierte en una justa causa para el despido durante el per\u00edodo de prueba.<\/p><p>A este respecto, la Honorable Corte Constitucional, en la Sentencia T-1097 de 2012, consider\u00f3 que tal facultad no puede utilizarse de manera arbitraria, sino que debe basarse en la comprobaci\u00f3n de la falta de aptitudes suficientes para el puesto.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-ffaf40a\" data-id=\"ffaf40a\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap\">\n\t\t\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-1de8af1 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"1de8af1\" data-element_type=\"section\" data-e-type=\"section\" data-settings=\"{&quot;ekit_has_onepagescroll_dot&quot;:&quot;yes&quot;}\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element elementor-element-1d78065\" data-id=\"1d78065\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-c11ab1d elementor-widget elementor-widget-text-editor\" data-id=\"c11ab1d\" data-element_type=\"widget\" data-e-type=\"widget\" data-settings=\"{&quot;ekit_we_effect_on&quot;:&quot;none&quot;}\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>En resumen, un empleador puede despedir a un trabajador durante el per\u00edodo de prueba, siempre que exista una justa causa objetiva, en este caso, la falta de aptitudes. Adem\u00e1s, es importante destacar que, si el trabajador es despedido sin justa causa durante el per\u00edodo de prueba, no se aplican indemnizaciones por despido injusto ni preaviso.<\/p><p>Por \u00faltimo, es esencial realizar la desvinculaci\u00f3n del trabajador antes de que finalice el per\u00edodo de prueba, ya que despu\u00e9s de este per\u00edodo, el empleador pierde la facultad de desvincular al trabajador en tales condiciones. En consecuencia, tanto empleadores como trabajadores deben comprender las normativas y consideraciones relacionadas con el per\u00edodo de prueba para garantizar un proceso justo y legal en el \u00e1mbito laboral.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t<div class=\"elementor-column elementor-col-50 elementor-top-column elementor-element
